L’Autorité ontarienne de réglementation des services financiers (ARSF) continue de donner la priorité à la protection des consommateurs et à l’efficacité de la réglementation dans le secteur du courtage hypothécaire. Dans le but d’harmoniser ces efforts, l’ARSF travaille à la mise en œuvre d’une dispense de permis proposée par le gouvernement de l’Ontario pour certaines entreprises effectuant des opérations hypothécaires.

L’ARSF procède actuellement à des consultations sur la ligne directrice proposée concernant l’admissibilité à la dispense de permis en vertu des modifications proposées au Règlement de l’Ontario 407/07 pris en application de la Loi de 2006 sur les maisons de courtage d’hypothèques, les prêteurs hypothécaires et les administrateurs d’hypothèques (la « Loi »). La dispense s’applique à certaines entreprises qui ne font pas affaire avec des consommateurs individuels. Cette ligne directrice reflète l’interprétation de l’ARSF des types d’entreprises qui seraient dispensées de l’obligation de détenir un permis auprès de l’ARSF.

L’ARSF et le ministère des Finances, en consultation avec le secteur, travaillent en collaboration pour mettre en œuvre les recommandations du rapport 2019 sur l’examen de la Loi par le gouvernement.

I strongly believe that no person or entity should be exempted from Mortgage services licensing. Doing so will create utter chaos in the industry. Compliance and monitoring and consumer protection will be impossible. Everyone wishing to do mortgage service business should be licensed and be subjected to the same Rules and Regulations that apply to licenced Mortgage Brokers and Agents.

IT SHOULD BE MANDATORY FOR ALL TO BE THE SAME LICENCING QUALIFICATIONS.
