General comments

The Chair of the Board welcomed the Committee to the meeting and provided introductory remarks about the importance of sector engagement. She noted that the Board recognizes that effective engagement builds a stronger regulatory working relationship and trust and that it is important that both FSRA and its stakeholders share valuable information through open and strategic discussions.

The Executive Vice-President, Policy & Chief Consumer Officer, FSRA, commented on the new HSP Committee criteria and terms of reference (TOR), highlighting that under the new Committee, the TOR focus on stakeholder input and guidance on FSRA’s oversight of HSPs who bill through Health Claims for Auto Insurance (HCAI) and that the membership has been broadened to ensure Committee members can provide advice to FSRA related to the revised focus of the HSP Committee on supervision.

The Chair of the Board noted that as part of their governance role, the Board would like to better understand the Committee’s environment, needs, and interests with a focus on forward looking activities and asked the Committee to comment on the factors or changes in their sector that FSRA should consider within its supervision work in terms of HSP business practices and billing in HCAI, key market conduct risks for HSPs and principal representatives in particular, and critical factors in increasing compliance in the HSP sector.

Common themes discussed included, but were not limited to:

  • enhancing FSRA’s supervision approach to create more effective billing practices in HCAI, including providing more guidance for licensees on codes, use of data from billing, updating current forms, and supervision outreach
  • the need for more education, training and orientation to licensees
  • leveraging data for predictive analytics for HCAI for greater focus on outcome-based results instead of transactional care
  • providing more clarity on the intersection between the colleges and the regulatory regime
  • ensuring there are forums to discuss issues outside of the Committee mandate

The Chair thanked the Committee for their insight and helping the Board focus on the strategic issues for the sector. The Executive Vice-President, Policy & Chief Consumer Officer, FSRA, thanked the Committee and assured the Committee that FSRA will continue to direct both previous and current Committee members (and other HSPs) to the appropriate ministries, regulators and committees for all issues that fall outside of the scope of the Committee. He also noted that FSRA will use its forthcoming Technical Advisory Committee for Auto Insurance Products as a forum for HSPs to, working with other members of the committee, identify problems and propose potential solutions for the benefit of consumers.
